Terms of Service on SK Magic App

Chapter 1 General Provisions

Article 1 (Purpose)
The purpose of the terms of service (the "TOS" hereinafter) is to define and specify the rights, obligations and responsibilities of both users and SK Magic Co., Ltd. (the "Company") upon the use of service (the "Service") provided by SK Magic App ("SK APP"), an application operated by the Company.


Article 2 (Definitions)
① The terms used in this TOS shall be defined as follows:
1. The term, "App Service," means a service designed for the Company to remotely control a product configured by the users within "SK App," check indoor air quality and provide statistical data concerning indoor air quality through mobile information/communication devices, Wi-Fi router and Wi-Fi network;
2. The term, "user(s)," means a customer who receives all services provided by the Company in accordance with this TOS after accessing or visiting the "SK App";
3. The term, "user number," means a combination (ID) of letters and numbers granted by the Company for the purpose of identification of users and helping users access the Service;
4. The term, "password," means a combination of numbers which a user is allowed to set up for the purpose of verifying whether those numbers are identical with the user number granted to the user in order to protect the rights and interests of the user;
② Definitions of all terms used in this TOS except the definitions prescribed in Paragraph 1 shall be governed by applicable laws and regulations, and those terms not stipulated by applicable laws and regulations shall be in compliance with general commercial practices;

Article 3 (Indication, Description and Amendment of TOS)
The effects of this TOS shall commence to all users.
① The App Service shall post the contents of this TOS, trade name, name of the representative, address of offices (including the address where consumers may file complaints), telephone number, facsimile number, email address, corporate registration number and mail-order business registration number on the initial service screen of the App Service in order for users to easily notice, and shall take all necessary technical
measures to ensure the users to print the entire details of the above and verify the contents of TOS during the course of transaction.
② The Company, when necessary for operation of the Service, may amend this TOS within the scope not violating applicable laws and regulations. The TOS following the amendments shall apply to agreements executed after the date of enforcement whereas the TOS prior to the amendments shall apply all agreements already concluded prior to the amendments: Provided that the amended TOS shall apply if a user expresses the will to have the amended TOS apply to the App Service within the period of announcing the amendments and the App Service agrees to the above.
③ In the event of amendment of the TOS, the Company shall make public announcement by posting the scheduled amendments on the service screen 7 days prior to the enforcement date or through other means: Provided that when the TOS is amended unfavorable to users, the announcement shall be made with at least 30 days or longer of advance grace period. Upon such occasion, the App Service shall be displayed for users to easily understand by explicitly comparing the contents of TOS before and after the amendments.
④ When a user refuses to consent to the amended TOS, the access of the Service may be suspended. When a user continues accessing the Service after the TOS is amended, the user shall be deemed to have agreed to the amended TOS.

Article 4 (Subsidiary Regulations)
① The Company may stipulate detailed matters concerning individual service other than this TOS, and those details shall be notified through a user guideline on relevant services and separate terms of service.
② All matters not prescribed by this TOS and interpretations of this TOS shall be subject to the Act on the Consumer Protection in Electronic Commerce, etc., Act on the Regulation of Terms and Conditions, Act on Promotion of Information and Communication Network Utilization and Information Protection, etc., Personal Information Protection Act, guidelines and applicable laws on the consumer protection in electronic commerce, etc. by the Fair Trade Commission and generally accepted commercial practices.

Chapter 2 Use of Service

Article 5 (Provision and Modification of Service)
① The App Service shall provide users the following services:
A. Remote control of products registered to the SK App by users;
B. Provision of information on the conditions of products registered to the SK App by users;
C. Verification of conditions, including indoor air quality, fine dust, fine particulate matter, temperature and humidity, surrounding products registered to the SK App by users;
D. Connection to customer service;
E. Provision of links to shopping malls concerning product purchases;
F. All other services provided to users through SK App by the company;
② The App Service reserves the right to modify the details of this Service, and all details of modified services and date of provision shall be announced through the screen at the site of SK App.

Article 6 (Service Hours and Suspension of Service)
① In principle, the service hours of the App Service shall be 24 hours a day unless a special circumstance arises from technical or operational reasons of the App Service: Provided that the day or hours specified by the App Service for the purpose of regular maintenance shall be exempted.
② The App Service may temporarily suspend the provision of service when a user violates his/her obligations prescribed by this TOS concerning the Service or other applicable laws and regulations.
③ When the App Service cannot be provided based on the grounds of conversion of business type or abandonment of operation, the above shall be notified through the screen at the site of SK App.

Article 7 (Use of Service)
① A user shall access Google Play or App Store at the mobile phone and install the SK App.
② A user shall select a language to use upon his/her initial access to the App Service (SK App is available in English and Arabic). The language of choice can be changed later in time.
③ A user of the App Service is allowed to set up a password with a combination of numbers to execute the screen of SK App where the information on the password set up by the user shall not be collected (Password is not installed at the time of initial execution of App Service). No limits are imposed upon the number of entries concerning wrongful entry of password.
④ When the list of home appliances accessible to the App Service shows up by pressing the "Registration" button at the screen of "List of Home Appliance," a user shall register the model name of home appliances (e.g. ACLV16BRTL) to use the App Service from the screen of "List of Home Appliance."
⑤ When a home appliance to use the App Service is selected, the information of the home appliance concerned shall be recognized by the SK App through Wi-Fi. The Wi-Fi near the home appliance to use the App Service shall be recognized; and the user can use the SK App by entering the password of the Wi-Fi concerned after selecting the Wi-Fi being used within the space of use: Provided that the App Service cannot be accessible at the space where Wi-Fi is not protected by password.
⑥ The App Service shall become active only when connected to the Wi-Fi of which password is established through a Wi-Fi router or Wi-Fi network; and the Service shall become available after the password of the Wi-Fi connected is entered through the screen of SK App. Information on passwords of Wi-Fi shall not be collected. For iPhone users, a user may select the Wi-Fi in use by connecting to "Set up - wifi" of the mobile device concerned.
⑦ When Wi-Fi is connected to the SK App, the model name of registered home appliances shall be displayed at the screen, and the registration shall be completed after a nickname of the home appliance concerned is set up.
⑧ The App Service shall grant a user number to a user without a separate procedure for membership registration; and upon such occasion, personal information of the user, such as name and e-mail address, shall not be collected.
⑨ A user shall access the App Service with the existing user number if the user has once installed and deleted the App Service and then re-install the App Service.
⑩ Withdrawal from the use of App Service shall not require a separate procedure as the privilege of service access shall be limited when the SK App is deleted.
⑪ To help users access the customer center, the App Service shall require an authority to access the phone book at the user's mobile device; and upon such occasion, consent to the authority above shall be acquired from the users.

Chapter 3 Obligations of App Service and Users

Article 8 (Obligations of App Service)
① The App Service shall not engage in any acts violating applicable laws and regulations, including the Act on the Consumer Protection in Electronic Commerce, etc., Act on the Regulation of Terms and Conditions, Act on Promotion of Information and Communication Network Utilization and Information Protection, etc. and Personal Information Protection Act, and any acts prohibited by this TOS or violating public order and good morals, and shall make best efforts to provide goods and services in continuous and stable manners as prescribed by this TOS.
② The App Service shall be equipped to security systems to protect personal information of users in order to ensure users to safely access internet services.
③ The App Service shall be held liable to compensation for damages when users suffer damages as the App service commits unfair labeling and advertising against Article 3 of the Act on Fair Labeling and Advertising concerning goods and services.

Article (Attribution of Copyright and Restriction of Use)
① All copyrights and intellectual property rights to the works prepared by the App Service shall be attributed to the App Service.
② From information obtained through the use of App Service, users shall not use or allow third party to use the information, of which intellectual property rights are attributed to the App Service, for pursuit of profit by means of reproduction, transmission, publication, distribution, broadcasting or other means without prior consent from the App Service.
③ When the App Service uses copyrights attributed to a user under agreements, the App Service shall notify the user of the above.

Chapter 4 Mediation of Dispute

Article 10 (Mediation of Dispute)
① The App Service shall install and operate a customer center, a body of handling compensation for damages, in order to accommodate just opinions or complaints raised by users and to compensate and process the damages.
② The App Service shall place priority upon handling of complaints and opinions submitted by users: Provided that when prompt handling of the above is unattainable, the App Service shall immediately notify the users of the grounds for the delay and subsequent schedule.

Article 11 (Indemnity)
① The Company shall be indemnified from liability for inadequate provision of the service in the event of natural disaster, state of national emergency, order of government or regulatory authority or other unavoidable incidents equivalent to force majeure.
② The Company shall not be held liable when a user fails to acquire or loses expected earnings by using the Service.
③ The Company shall not be obliged to intervene or monitor transactions between users or user and third party with the Service as a medium, and shall be indemnified from any liabilities for the above.
④ When a user suffers damages arising from incidents where details of communication or personal information are divulged from communication devices (Wi-Fi device, etc.) and communication sections used by the user, the Company shall be indemnified from liabilities to the user unless intention or negligence committed by the Company uncovers.

Article 12 (Jurisdiction and Governing Law)
① All disputes arising from or out of interpretation of this TOS or between this TOS and users shall be subject to the laws of the Republic of Korea.
② All litigations under Paragraph 1 above are subject to the exclusive jurisdiction and venue of the courts governing the jurisdiction of principal location of business of the Company.


ADDENDA
(Enforcement Date)
The TOS shall enter into force on February 28, 2018.
